    The top image is not a triangle; if you look at the gradients of the two smaller triangles, they differ (the smaller is 2/5, whilst the larger is 3/8, i.e. the former is steeper). So, in the first arrangement, the 'hypotenuse' is sort of convex, and, in the second, it's concave (exaggerate their properties and you'll see my point). The 'missing square' arises because of this (think of it as somewhere for the area of the triangle which the 'hypotenuse' cuts out to go).

    The slopes of red + green triangles are different. Slope of red is (rise / run ) 3/8 ; slope of green is 2/5. This creates the extra space/gap. It's because in the first image, red is on bottom, so it'll bend away from the base of the triangle. In the second image, green is on bottom, so it'll bend toward the base of the triangle. And because it bends toward the base, there's an extra partition that's created.
